RE-REGISTRATION IN ALL GOVERNMENT BODIES AFTER THE PURCHASE OF REAL ESTATE

After selecting the right object, signing an agreement on the purchase of real estate and payment, we do not abandon our customers halfway and continue supporting them. Our real estate agents have a legal basis to support the transaction right to the end. Slovak legislation makes impossible the illegal activities of real estate agents.

 

A real estate agent is obliged to have a record in the section of activities: “mediation in the sale, lease, and purchase of real estate (real estate activities)” in the extract about his company in the Commercial Register of the Slovak Republic.

 

A real estate agent checks that the new owner is registered in the Slovak Land Register according to all the rules and that the new owner is re-registered in all other government bodies. A real estate agent also helps to:

 

  • fill out the application form for the real estate title transfer from the seller to the buyer;
  • obtain a certificate from the management company confirming the absence of utility bills arrears;
  • obtain from the Real Estate Cadastre the permission to transfer real estate title to the new owner and a Title Deed in the buyer’s name;
  • register in the tax department of the Mayor’s office or village council and pay the tax that the Mayor’s office or village council will calculate and send to a buyer.

Where to go to process the documents?

When processing the documents, we accompany you to the Foreign Police Department to submit the application in person.   You can also submit the application in person at the Foreign Police Department at your place of residence if: - you are in Slovakia on the basis of a valid temporary residence permit; - you are in Slovakia on the basis of a valid national visa; - you do not need a visa to stay in Slovakia; - you are the holder of a Certificate of a Slovak living abroad; - you have been granted tolerated residence (acc. to Paragraph 58 section 1, points a-c or section 2)   If you are not in Slovakia, the application is submitted to the Embassy of the Slovak Republic in your country. At the embassy, you have a personal interview for the purpose of a preliminary assessment of the application.

How to duly translate documents into the Slovak language?

It all depends on the type of documents and the agreement concluded by your country. Certification of translation is not required for countries that are state parties to the Hague Convention. This means that in order to use abroad documents issued in such a country, you only need to apostille them.   Apostilled documents must not only be translated into Slovak but the translation must be made by a sworn translator and bound to a notarized copy of the document. What is important to know about taxation in Slovakia?

Income tax rates are as follows: - 19% - individuals - 15% - legal entities with a turnover of up to 100 thousand - 21% - legal entities with a turnover of more than 100 thousand   If the amount of tax exceeds 5 thousand, there is an obligation to pay quarterly advance payments.    Dividends are taxed at a 7% rate.

If a foreign citizen has purchased real estate, can this be a basis for obtaining a residence permit, permanent residence, or Slovak citizenship?

Purchase of real estate in Slovakia is not a basis for obtaining a residence permit or permanent residence in Slovakia.   The Foreign Police Department of Slovakia grants permits for temporary residence not on the basis of something, but for a specific purpose.   A residence permit in Slovakia can be obtained for the following purposes: - business; - employment; - study; - family reunion; - EU blue card; - civilian units of the armed forces; - special activities; - research and development; - status of a Slovak Living Abroad.
